                         FLORIDA NO-FAULT ACT

Since Florida is a "no-fault" state, your automobile insurance will include coverage for personal injury protection (PIP) and property damage (PD).  This is the minimum coverage required by Florida Law.

Personal injury protection (PIP) insurance pays a percentage of your medical bills if you are hurt in an accident, typically 80% with extended coverage available from many insurance companies.

If you elected this extended coverage, known as med-pay coverage, you will be afforded additional medical coverage for your medical bills if you are injured in an accident.

You can also claim lost wages through your PIP coverage if you miss time from work due to an injury from the auto accident, typically paying 60% of your gross average weekly wage.

This is called the No-Fault Act because your insurance company pays your medical bills and lost wages up to the coverage limits (typically $10,000 with the possibility of a deductible), regardless of who was at fault in causing the accident.

If you are in an accident, it is important you discuss your no-fault benefits coverage with your insurance company so you understand the coverage you have, or better yet, discuss these coverages with your attorney.  Your attorney can best advise you how you should apply for such coverages, especially if you have both medical expenses and lost wages, so as to maximize the benefits and coverage to yourself.
