Attorney Fees

The Law Office of David Gorewitz PA will represent the Plaintiff’s interests in a personal injury claim on a contingency basis. If there is no recovery, the Plaintiff will owe nothing to the law firm. If there is a recovery, the attorney will be entitled to a percentage of the award or settlement.

When bringing suit against your insurance company for breach of contract, your insurance company will be responsible for your attorney fees if you win your claim against it.

If you bring a claim for breach of contract against another person or business, if any party under that contract is entitled to attorney fees, then all persons under the contract are entitled to attorney fees should they win at trial.

Oftentimes the winner of a lawsuit in Florida may be entitled to attorney fees from the losing party.  By strategically offering to settle at the proper time in a lawsuit and then beating that offer at trial, many of our clients have been awarded fees as a consequence of a favorable jury verdict and have collected the entire jury award without having to share a percentage with their attorney.

You may also read some of our published jury verdicts where we have been awarded attorney fees due to winning our clients' cases at trial  For example:  please see case 1, case 2case 3case 4 and case 5.  In these cases, among others, because we strategically offered to settle our clients' cases for an amount rejected by the defendants and we then won at trial, we received court orders compelling the defendant to pay our clients' attorney fees.  Our clients therefore did not have to pay their attorney out of their recovery and were more fully compensated for their injuries.
